 It is mutually agreed that the following terms of agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by both BCK Photography and the client, in writing.

 

BOOKING FEE: An agreed deposit is required at the time of booking, together with a signed contract. Dates are reserved only when this fee is received by cash, cheque, or BACS. Please make cheques payable to BCK Photography. Due to the nature of the business of wedding photography, the deposit is non refundable.

 

BALANCE PAYMENT: The balance of payment is split. After the deposit has been paid, the final balance is due 4 weeks prior to the wedding date. Payment for additional album photographs, prints & frames is made after the wedding at the time of ordering.

 

CREATIVE LICENCE: BCK Photography shall be granted creative and artistic license in relation to the choice of locations and poses used. BCK Photography’s judgment on photographic style, colour and the number of photographs taken, shall be deemed correct. Due to changes of the weather and the availability and willingness of subjects, we will do our best to honour requested photographs but does not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

 

VIEWING: A disc of all edited photographs will be sent to you normally within 30 days of the wedding date. This disc is for you to keep and to select the photographs for your album, or book if applicable. If there is a time delay in getting the images to you, this may be due to unforeseen circumstances, and in this event, the photographs will be sent as soon as is practicable. We strongly advise you back up your photographs on your own external hard drive or other disc.

 

COPYRIGHT: The 1998 Copyright, Designs, and Patents Act has been lifted on your wedding photographs by kind permission of BCK Photography, for use on social media and to be reprinted. Where appropriate and possible, we do ask that our name be associated with the presentation of the photographs.

 

FORCE MAJEURE: In the unlikely event of total photographic failure, injury or sickness beyond our control, my liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected.

 

CANCELLATION: If BCK Photography has to cancel this contract for reasons beyond his control, (death, injury, sickness etc.), his liability shall be limited to a full refund of all monies paid. The client may cancel this contract at any time. However, due to loss of earning’s will be entitled to no monies returned.. Should the cancelled wedding turn out to be a postponement, then, subject to availability, all money paid may be applied to the new wedding. In this case, the total fees chargeable shall be the fee which applies at that time. 

 

EXCLUSIVITY: BCK Photography shall be the sole professional (still) photographer at the venues specified. Due to the amount of guests with camera systems, BCK photography cannot guarantee that all guests will be looking directly at the camera at the time of taking the picture

 

COMPLAINTS PROCEDURE: Please address any complaints to BCK Photography either by Email or letter. All complaints must be received within 10 days of the disc arrival with you. We would endeavour to respond to any complaint within 48 hours. 

 

WEDDING ALBUMS: We reserve the right to change wedding albums with prior written warning to our clients. This may happen if a range of albums is discontinued by a manufacturer. We also ask that all decisions on images for wedding albums are chosen within 3 months of the wedding date. If pictures have not been chosen after a 6 month period further charges may apply.

 

USE OF IMAGES: BCK Photography reserves the right to use wedding images for advertising, creating albums for wedding venues, web sites and mail shot campaigns. Please indicate in writing if you would prefer your images not to be used.

 

SAFETY: BCK Photography reserves to right to terminate coverage and leave the location of the Wedding if we experience inappropriate, threatening, hostile or offensive behaviour from person(s) at the Wedding or in the event that the safety of the photographer(s) is in question.

 

RAW FILES: BCK Photography shoot all their professional assignments in RAW files. All photographs are edited in RAW files for maximum ability to edit to the highest possible standard. The client will receive their photographs as Jpeg files, and under no circumstances will the original RAW files be supplied. This is due to manipulation of original photographs, edited by any persons, to a standard BCK Photography would not be happy with, and have our names associated with.

 

ADJUSTMENT OF YOUR PHOTOGRAPHS: If there are any amendments to be made to your disc of photographs for example: Colour shots to black & white, or vice versa. A change of crop or white balance, then this request must be made no later than 30 days of the receipt of your photographs. After 30 days, the original RAW files are deleted from the computer, and we then work with original Jpeg photographs. 

 

BODY PARTS & EQUIPMENT: Due to the further increase in mobile phone technology, small camera’s, and larger camera’s with long lenses owned and carried by guests; at vital times where the bride & groom may be walking down the aisle or any other given circumstance like confetti being thrown – BCK Photography will not be responsible for guests, who decide to stand in front of us, lean into the aisle and obstruct our view. We can only photograph what is in front of us, and on occasions guests do this without thinking. Whilst we endeavour to capture these moments perfectly, the situation becomes out of our control.

 

TRAVEL: Whilst we plan to minute detail, timings and mileage of the wedding locations we photograph at, and leave hours before we are required and often the night before, BCK Photography will not be held responsible for any unforeseen hold ups, crashes or any obstacle’s that arise, and delay our attendance due to other road users or circumstances out of our control. The exception to this and this alone is the running out of petrol.  

 

COLOUR MATCHING: Owing to reflectance caused by a combination of certain dyes and materials, especially man made fibres, it is sometimes impossible to record the exact colour of a garment as seen by the human eye.
